Evolución histórica del ordenamiento jurídico que rige la ciencia, la tecnología y la innovación en Venezuela (1989 – 2026)

La naturaleza dinámica del derecho permite que el ordenamiento jurídico se adapte a las transformaciones sociales, siendo la ciencia, la tecnología y la innovación (CTI) catalizadores fundamentales de este proceso. Este artículo tiene como objetivo analizar la trayectoria histórica del marco jurídico que regula la CTI en Venezuela durante el período 1989–2026. Para ello, se empleó una metodología de corte dogmático-jurídico con enfoque histórico, estructurando el análisis en tres etapas: 1989–1998, 1999–2012 y 2013–2025. Los resultados evidencian una tendencia legislativa orientada hacia la democratización de la CTI, concibiéndolas como actividades inclusivas capaces de ofrecer soluciones a problemáticas nacionales. El estudio concluye que, pese a la brecha existente entre la normativa vigente y la práctica fáctica actual, el cuerpo legal se mantiene como el referente normativo fundamental —el «deber ser»— que guía la gestión del desarrollo científico y tecnológico del país

| Resumen en otro Idioma | The dynamic nature of law allows the legal framework to adapt to social transformations, with science, technology, and innovation (STI) acting as fundamental catalysts in this process. This article aims to analyze the historical evolution of the legal framework regulating STI in Venezuela during the 1989–2026 period. To achieve this, a dogmatic-legal research methodology with a historical approach was used, dividing the analysis into three stages: 1989–1998, 1999–2012, and 2013–2025. The results show a legislative trend oriented toward the democratization of STI, conceiving them as inclusive activities capable of providing solutions to national issues. The study concludes that, despite the existing gap between current legislation and actual contemporary practice, the legal body remains the fundamental normative reference—the "ought to be" (deber ser)—guiding the management of scientific and technological development in the country |
