El régimen de copia privada ha sufrido grandes cambios en el Derecho español en los dos últimos años. De hecho, en la actualidad existe un proyecto de ley cuyo fin es modificar, una vez más, aquel régimen a fin de redefinir los supuestos en que los titulares de derechos pueden ser compensados
como consecuencia de las copias privadas realizadas por el público. Se describen las claves del nuevo sistema establecido y critíca algunos aspectos del mismo. Principalmente, la drástica
reducción de la compensación económica debida y el nuevo concepto de «copia privada», que
reduce significativamente su ámbito con respecto a la anterior legislación.

Resumen en otro Idioma | The Spanish regulation on private copying has been significantly modified in the last two years. In fact, a bill has been recently filed in Parliament in order to modify this issue once again and redefine cases in which copyright holders may be entitled to receive compensation for private copying. The author of this article points out the keys of this regulation while criticizing some aspects of the incoming legislation. Main items emphasized are the drastic reduction of equitable compensation and the new concept of “private copying”, which significantly reduces the scope of this limitation as compared to the previous legislation. |
