La ascendente globalización y dinamización del mercado han demostrado la indispensabilidad
del uso de las marcas como signos distintivos de comercio. El ordenamiento jurídico portugués,
a través de variados instrumentos comunitarios, reglamenta esta materia concediendo un
tratamiento especial a las marcas celebres. En efecto, mientras las restantes marcas, normales
y renombradas, operan dentro del funcionamiento del principio de la especialidad (pilar del
Derecho de Marcas), las célebres exceden tales reglas. Ante tal diferencia de tratamiento, urge
demarcar los conceptos de marca celebre y de marca renombrada. Comparando los enunciados de
la jurisprudencia con los de la doctrina, es objetivo central del estudio demarcar los mencionados
conceptos, tan próximos en su definición pero tan apartados en el tratamiento jurídico que reciben.

Resumen en otro Idioma | The market’s increasing globalization and dynamism have proved mark use indispensable as distinctive signs for trade. The Portuguese legal system regulates this area by conceding special treatment to famous brands. In fact, while standard or well-known trademarks only obtain protection within the same kind of products and/or services that distinguish them, famous brands are protected in relation to all products and services. In the presence of such differences in treatment, it is imperative to delineate the concepts of the well-known and the famous mark. The main objective of this study is to define the concept of famous brands and what distinguishes them from other types. This is vital since opinions differ (in theory and in practice), a fact which can cause material injustice. |
