La cuestión de buscar un concepto de bien jurídico y criterios que permitan su delimitación, ha estado presente siempre en la dogmática penal. En este artículo, se pretende presentar un breve esbozo de la senda por la que ha transitado la teoría del bien jurídico, con el fin de sentar las bases teóricas necesarias para adoptar una concepción operativa del mismo, que posibilite un adecuado análisis de esta figura en el estudio de cualquier tipología penal.
