El trabajo versa sobre el concepto de arte, tradicionalmente ubicado como objeto del derecho de autor, para vincularlo con los derechos de propiedad industrial, con el fin de determinar los supuestos en que existe una acumulación de protección por ambas disciplinas, porque el arte no solamente incluye a las expresiones humanas que pretenden alcanzar el valor de «belleza», sino también a las que tienen una finalidad distintiva o un destino utilitario aplicable a la industria. De allí que existan diferentes zonas fronterizas entre el derecho de autor y los derechos que protegen a las creaciones técnicas y a los medios identificadores de productos y servicios. El estudio determina las vinculaciones entre el «arte literario» y las invenciones; el «arte figurativo» y los signos distintivos gráficos; el «arte literario» y los signos distintivos nominativos; el «arte publicitario» y los medios identificadores de bienes y servicios; el «arte musical» y las marcas sonoras; el arte aplicado, los diseños industriales y la indumentaria; y el «arte figurativo» en su relación con los modelos
de utilidad, con el fin de establecer la doble y hasta la triple protección de esos bienes intelectuales, a la luz de la legislación comparada, la doctrina y la jurisprudencia nacional y extranjera. Finalmente, se analizan las ventajas que
existen cuando se cumplen los supuestos de una protección acumulada, como también los casos en que dicha tutela simultánea debe ser descartada.

Resumen en otro Idioma | The study develops the concept of art, traditionally treated as an object of copyright, for relating it to industrial property rights, with the purpose of determining the cases where there is an accumulation of protection under both disciplines, since art not only includes the human expressions trying to reach the «beautifulness» value, but also the ones having a distinctive function or a practical destination applicable to industry. This is the cause why there are different border zones between copyright and the rights which protects technical creations and the identifying means of products and services. The study determines the relationship between the «literary art» and the inventions; the «figurative art» and the graphical distinctive signs; the «literary art» and the nominative distinctive signs; the «advertising art» and the identifying means of product and services; the «musical art» and the sound marks; the applied art; the industrial design and clothing; and the «figurative art» in their relationship with utility models, with the purpose of establishing a double and even triple protection of these intellectual goods, under the light of comparative legislation, and both national and foreign doctrine and jurisprudence. Finally the existent advantages when the requirements for an accumulative protection are fulfilled are analyzed, as well as the cases when such simultaneous tutelage should be ruled out. |
