| dc.description.abstract | En el presente artículo se pretende reevaluar la implementación del agotamiento de los
derechos
de propiedad intelectual como limitación del derecho de autor sobre la distribución de
obras
protegidas en el entorno digital, dada la estimulación de medidas tecnológicas de
protección de
obras que limitan el uso de ejemplares lo que dificulta la operación de mercados
secundarios,
generando nuevamente tensiones en la interrelación del derecho de autor y los derechos
económicos y al libre acceso a la información y la cultura que habían sido aliviadas
con la figura del
agotamiento; de igual forma reconsiderar la aplicación del agotamiento a la luz de la
jurisprudencia
europea y estadounidense y nuevas formas tecnológicas de reproducción y distribución
