dc.description.abstractEn el presente artículo se pretende reevaluar la implementación del agotamiento de los derechos de propiedad intelectual como limitación del derecho de autor sobre la distribución de obras protegidas en el entorno digital, dada la estimulación de medidas tecnológicas de protección de obras que limitan el uso de ejemplares lo que dificulta la operación de mercados secundarios, generando nuevamente tensiones en la interrelación del derecho de autor y los derechos económicos y al libre acceso a la información y la cultura que habían sido aliviadas con la figura del agotamiento; de igual forma reconsiderar la aplicación del agotamiento a la luz de la jurisprudencia europea y estadounidense y nuevas formas tecnológicas de reproducción y distribución de obras.es_VE

dc.description.abstract1This article aims to reevaluate the implementation of the exhaustion of intellectual property rights as a limitation of copyright on the distribution of protected works in the digital environment, given the stimulation of technological protection measures of works that limit the use of copies, which hinders the operation of secondary markets, again generating tensions in the interrelation of copyright and economic rights and free access to information and culture that had been alleviated by the figure of exhaustion; in the same way, reconsider the application of exhaustion in the light of European and American jurisprudence and new technological forms of reproduction and distribution of works.es_VE
