| dc.description.abstract | La Ley de Propiedad Industrial de 1955 establece la posibilidad de que, una vez otorgado el registro
marcario, aquel tercero que se considere titular de un mejor derecho sobre la marca referida, puede
demandar ante la jurisdicción la nulidad del registro respectivo. Este trabajo intenta explicar las
consecuencias de una deficiente redacción legal, el proceso que la acción de nulidad conlleva y el
estudio de qué tipo de acción corresponde en la demanda judicial para el reconocimiento de un
mejor derecho, así como algunos ejemplos de las pruebas oponibles en que basar el mejor derecho

been granted, any third party believing to have a better right on said trademark may file an action
for annulment of its registration before the competent jurisdiction. This article attempts to explain
the consequences derived from inadequate legal phrasing, the process which the annulment action
