| dc.description.abstract | Luego de doce años y mediante Ley
Habilitante, el presidente de Venezuela
Hugo Chávez que se ha autodefi nido
como “un presidente obrerista” para
signifi car que está al lado de los trabajadores
y trabajadoras, promulgó mediante
el Decreto N° 8.938 del 30 de
abril de 2012 el Decreto con Rango,
Valor y Fuerza de “Ley Orgánica del
Trabajo, Los Trabajadores y Las Trabajadoras”,
cumpliendo así con el mandato
del pueblo delegado a los constituyentistas
en la Asamblea Nacional
Constituyente de 1999. El presente
trabajo expone los principios rectores
del proceso social del trabajo y su desarrollo
jurisprudencial aplicado por el
Tribunal Supremo de Justicia para esta
novísima Ley. El presente artículo es

principles of the social process of work,
which was applied by the Supreme
Court of Justice for this recently passed
