dc.description.abstractLa protección jurídica de la cultura popular tradicional está en la atención de organizaciones internacionales como la UNESCO y la OMPI. La legislación de protección del patrimonio cultural, las normas de Derecho de autor o más recientemente, normas sui generis con un tipo de protección diferente que tutela aspectos de propiedad intelectual, son algunas de las opciones más conocidas. El presente artículo aborda las divergencias y posibles congruencias entre el sistema tradicional de propiedad intelectual para las “expresiones del folklore” y el sistema de salvaguardia del patrimonio cultural. Se analizan aspectos tales como, la diversidad de definiciones sobre su objeto, el significado de la protección respecto al valor, fines, duración, medidas, y su comportamiento en la legislación cubana.es_VE

dc.description.abstract1Protection of traditional popular culture is on the eye of international organizations as UNESCO and WIPO. The cultural heritage protection, the Copyright norms or recently, sui generis norms with a different protection type that guides intellectual property aspects, there are some of the known options. The present article refers the divergences and possible consistencies among the traditional system of intellectual property for “expressions of the folklore” and the safeguard system of cultural heritage. Such aspects are analyzed as, the diversity of definitions on their object, the meaning of protection regarding the value, ends, duration, measures, and their behaviour in the Cuban legislation.es_VE
