Abstract
El Dr. Mihály Ficsor , como presidente del Consejo de Derecho de Autor de Hungría,
escribió un
artículo publicado por la UNESCO en el año 2003 que tituló «La Gestión Colectiva del
Derecho
de Autor y los Derechos Conexos en una triple encrucijada: ¿Deberá seguir siendo
voluntaria o
podría “ampliarse” o establecerse de carácter obligatorio? Esta interrogante continúa
sin respuesta
en la mayoría de las legislaciones latinoamericanas. La gestión colectiva del derecho
patrimonial
de autor sigue siendo voluntaria, fundamentada en el ejercicio del derecho de
exclusiva que le
asiste al autor sobre su obra y, en pocos países, la gestión colectiva del derecho de
remuneración
o simple remuneración, es de carácter obligatorio; sin embargo, en la presente
investigación nos
proponemos determinar si los estados latinoamericanos están cumpliendo con sus
obligaciones
asumidas en las declaraciones y pactos sobre derechos humanos a través de la gestión
colectiva
voluntaria o, si por el contrario, están en deuda legislativa frente a los nuevas
ventanas de
explotación de las obras protegidas por el derecho de autor.

| Resumen en otro Idioma | Dr. Mihály Ficsor, as Chairman of the Hungarian Copyright Council, wrote an article published by UNESCO in 2003 entitled “Collective Management of Copyright and Related Rights at a triple crossroads: Should it remain voluntary or could it be “scaled up” or made mandatory? This question remains unanswered in most Latin American legislation. The collective management of the author’s patrimonial right continues to be voluntary, based on the exercise of the exclusive right that the author has over his work and, in a few countries, the collective management of the right to remuneration or simple remuneration is mandatory; However, in the present investigation we propose to determine if the Latin American states are complying with their obligations assumed in the declarations and pacts on human rights through voluntary collective management or, if, on the contrary, they are in legislative debt before the new windows of exploitation of works protected by copyright. |
