Históricamente el sistema de patentes está lleno de divergencias. Ya en 1860 partidarios del liberalismo solicitaron su abolición considerándolas instrumentos del proteccionismo. En 1873 triunfan el nacionalismo y el proteccionismo, permitiendo al sistema recuperarse y esparcirse apoyado en la revolución industrial, generando necesidad de reglas internacionales como el Convenio de París para la Protección de la Propiedad Industrial en 1883. Estandarizado el sistema(1994) mediante el Acuerdo sobre los Derechos de Propiedad Intelectual relacionados con el Comercio (ADPIC), surgen flexibilidades para aplicarlo dentro de límites previstos en su texto, que permitirían que cumpla con su papel motivador de la creatividad en países en desarrollo. Se analizan en este artículo algunas flexibilidades y su aplicación, incluyendo legislación, políticas y casos específicos.

Resumen en otro Idioma | Historically, the patent system has been full of divergences. By 1860, supporters of liberalism proposed to abolish it by claiming patents were instruments of protectionism. In 1873, nationalism and protectionism succeeded, allowing the system to recover and spread on the wings of the Industrial Revolution, creating the need for international rules such as the Paris Convention for the Protection of Industrial Property of 1883. The system was standardized (1994) by the Trade-Related Aspects of Intellectual Property Rights (TRIPS) which introduced flexibilities to implement it, within limits provided in its own text, allowing it to fulfill its role of motivating creativity in developing countries. Some flexibilities and their application are discussed in this article, including legislation, policies and specific cases. |
