La Universidad de los Andes y el instituto iberoamericano de derecho agrario y reforma agraria: una relación institucional sin resolver

El Instituto Iberoamericano de Derecho Agrario y Reforma Agraria es una Asociación Civil que, por razones fácticas, configuró una aparente adscripción a la Facultad de Ciencias Jurídicas y Políticas de
la Universidad de Los Andes. El Consejo de Facultad intentó definir esa situación irregular en dos oportunidades: en el año 2004 solicitó al Consejo Universitario un pronunciamiento sobre la naturaleza jurídicadel Instituto; pero como no obtuvo respuesta alguna, en el año 2010
presentó un informe sugiriendo la solución definitiva. Pero hasta el día de hoy no se ha hecho pública la decisión del máximo organismo universitario, que continúa tolerando la situación y actuación del referido
ente privado en el ámbito institucional. El objetivo de este escrito es abrir,
nuevamente, la discusión del caso y advertir de los posibles llamados
de atención, tanto del Consejo Nacional de Universidades como de la Contraloría General de la República.

Resumen en otro Idioma | The Spanish American Institute for Agricultural Law and Agrarian Reform is a Civil Association, for factual reasons, set an apparent attachment to the Faculty of Law and Political Sciences of the University of Los Andes. The Faculty Council has twice attempted to define the irregular situation. At first, University Council requested a ruling on the legal nature of the institute in 2004, but in that opportunity no response was submitted a report suggesting the ultimate solution in 2010. Up to this day the University Council has not made public the decision of the university’s governing body, which continues to tolerate the situation and the aforementioned private entity acting at the institutional level. The aim of this paper is to open again the discussion of the case and warn of potential sanctions, both the National Council of Universities and the Comptroller General of the Republic to the irregular status above. |
