Abstract
La protección penal de los bienes jurídicos intelectuales la establece el Título VII de la Ley Sobre
el Derecho de Autor. El Legislador tipifica ocho delitos, determinando en cada uno el bien
jurídico que se protege específicamente. Los comportamientos que afectan los bienes jurídicos
intelectuales deben ser intencionales por mandato expreso de la Ley y las acciones son las que
se corresponden típicamente con los delitos contra la Propiedad Intelectual Autoral. Desde la
perspectiva de la Teoría del Delito, tal afirmación aparece en la Exposición de Motivos de la Ley,
generando la necesidad de identificar tales bienes jurídicos, toda vez que han adquirido una gran importancia legitimadora de la punibilidad, por representar derechos positivamente necesarios para el convivir social y humano.

| Resumen en otro Idioma | Title VII of Copyright law establishes criminal protection over intellectual property assets. The Legislator typifies eight crimes, determining on each one the specifically protected property right. As expressly mandated by the law, criminal behavior affecting intellectual property assets must be intentional and actions are those that typically correspond to crimes against authorial intellectual property. From a Crime theory’s perspective such affirmation appears in the statement of purpose of the Law, generating the need to identify such legal assets, inasmuch they have acquired great importance legitimating criminal liability since they represent absolutely necessary rights for social and human coexistence. |
