El principio de legalidad se presenta como uno de los pilares fundamentales, si no el fundamental,
del Derecho Administrativo y como tal, el apego al mismo por parte de los órganos que integran la
Administración Pública, tanto en el ejercicio de sus funciones como en la definición de las políticas
públicas, es fundamental en la concepción de un Estado de Derecho. En el presente trabajo se
abordará la esencia del principio de legalidad, su importancia –y la de la Constitución– en el
ámbito de la Propiedad Industrial, y como su inobservancia ha sido el principal factor detrás de la
problemática de ésta área del derecho en Venezuela.

This paper addresses the essence of the rule of Law, its importance -and the Constitution’s- in the context of Industrial Property and how failure to comply with it has been the main factor behind the problems in this area of Venezuelan’s law. |
